Erie County Sheriff Timothy B. Howard reports deputies made three DWI arrests yesterday which included an arrest after a crash and one for violating Leandra’s Law.
March 9, 1:02 p.m.; Town of Grand Island – Deputy Biegasiewicz performed a traffic stop on Grand Island Boulevard after he observed a vehicle driving on the shoulder of the roadway, crossing over the yellow line, and speeding.  When the Deputy approached the vehicle, he observed a child on the back seat, not seated in a car seat, and alcohol in the cabin of the vehicle.  After Deputy Biegasiewicz’s investigation, Toh Bah, 57 of Buffalo, was arrested and charged with a felony count of Aggravated DWI (Leandra’s Law), drinking alcohol in a vehicle on a roadway, no car seat for a passenger less than 4-years-old, speeding, and lane violations.
The defendant refused a breath test and was transported to Erie County Medical Center for evaluation and treatment.  Bah is scheduled to appear in Grand Island Town Court on March 16.
March 9, 6 p.m.; Town of Clarence – Deputy Coulombe was responding to a disturbance call at a convenience store on Main Street but the subject and vehicle were gone upon his arrival.  The Deputy located the suspected vehicle and initiated a traffic stop. Subsequent to the Deputy’s investigation, the operator Jonathan McKibben, 37 of Clarence, was arrested and charged with DWI.  The defendant has a future court appearance in Clarence Town Court.
March 9, 11:48 p.m.; Town of Clarence – Deputy Richard responded to reports of a crash at Main and Transit roads.  The Deputy’s investigation resulted in the arrest of Christine Rizzo, 25 of Williamsville.  The operator was charged with DWI, refusing to submit to a breath test, and failure to maintain the lane of travel.  The defendant was released on tickets to a relative and will appear in Clarence Town Court at a later date.
