Sheriff Timothy B. Howard reports the early morning arrest of a Buffalo man for DWI following the traffic stop on Rt. 33 in the City of Buffalo.
Erie County Sheriff's Deputy Dan Harris was on the inbound Rt. 33 in the City of Buffalo Sunday morning just after midnight when a vehicle travelling next to him veered from it's lane and almost struck Deputy Harris' patrol vehicle.
A traffic stop was made and upon further interview and field sobriety tests, the driver, 34 y/o Darius R. Spates of Rickert St. in Buffalo, was found to be intoxicated.
Spates was arrested and charged with DWI and other traffic violations.
He refused all further BAC testing.
Spates' vehicle was towed from the scene and he was later released to a third party on appearance tickets to the City of Buffalo Court at a later date.
Deputy Harris was assisted at the stop by Deputies Justin Bauer and Timothy Christian.
This was the 188th DWI arrest by the Erie County Sheriff's Office this year.
