• DWI Arrest #179 - King

    Sheriff Timothy B. Howard reports the early morning arrest of a Town of Boston man for aggravated DWI, leaving the scene of a property damage accident and other traffic violations following his one car accident in the Town of Colden.
    The Erie County Sheriff's Office received information that a male subject, 27 y/o Justin C. King of Fisher Rd. in Boston, had crashed his car at an unknown location in the Colden area and was attempting to walk back to Boston.
    Fisher was located by Deputies Brad Ballantyne and Jon Hanna a short time later just as he arrived home after getting picked up in a vehicle.
    Further interview and field sobriety tests revealed that King was intoxicated.
    King stated he didn’t know where his car was or where he had the accident, but stated he ran into a tree.
    His vehicle was eventually located, crashed against a tree on Rt. 240 at Gutekunst Rd. in the Town of Colden. There was tree and property damage from the accident.
    King was arrested and charged with DWI, Leaving the scene of a property damage accident, and other various traffic violations.
    He submitted to a chemical breath test which showed a .21% BAC, almost three times the legal limit, subsequently turning the DWI charge into an Aggravated DWI.
    King's vehicle was towed from the scene and he was later released to a third party on appearance tickets to the Town of Colden Court at a later date.
    This was the 179th DWI arrest by the Erie County Sheriff's Office this year.
