Erie County Sheriff Timothy B. Howard reports that three people were arrested early this morning in the Town of Newstead on narcotics-related charges.
A 911 call for assistance was received from a Bloomingdale Road resident at 1:10 AM, reporting that someone was at the door to the house, screaming for help. Deputies Gene Nati and Jason Clark arrived a short time later, and found a very distraught female subject, reporting that a male subject may be in trouble in an apartment next door. Deputies Nati and Clark, along with two New York State Troopers, went to the apartment to check on the subject’s welfare. Once inside, they observed in plain view several hypodermic needles and other apparent drug paraphernalia, along with a clear plastic bag containing a white power, which was believed to be bath salts.
Arrested were Joshua S. Martaus, age 30, and Jenea M. Macleod, age 29, of Batavia. Both were charged with Criminal Possession of a Controlled Substance in the seventh degree, and Possession of a Hypodermic Needle, both of which are Class A Misdemeanors. In addition, Randy J. Biaselli Jr., age 32, who resides at the apartment, was charged with Criminal Nuisance in the second degree, a Class B Misdemeanor. This section prohibits “maintaining any premises where persons gather for purposes of engaging in unlawful conduct.”
All of the subjects were released on Appearance Tickets, returnable in the Town of Newstead Justice Court on March 19.
